      The Firm is also sensitive to the fact that litigation can be a difficult and costly experience.  The burden and disruption associated with litigation can be reduced by using arbitration and mediation to resolve disputes.  Alternative dispute resolution is a good option for those clients looking to resolve disputes but who may not be willing to give up their rights to go to court for an ultimate decision if a settlement cannot be reached. Timothy M. Ravich, Esq. has been qualified as a Supreme Court of Florida Certified Circuit Mediator and is experienced in mediating matters arising in areas of aviation business conflicts and extending to negotiations before administrative agencies including the Federal Aviation Administration ("FAA").  Representative aviation and litigation experience includes:

 

  • Airport Law. Prosecuted and defended rights of fixed-base operators ("FBOs") and Maintenance Repair Operators ("MROs") in contract and property disputes.  Counseled airports and airport vendors under Federal Aviation Administration airport cooperative plan in matters involving "grant assurances" and private-public partnerships.


  • Aviation Accident Litigation.  Counseled individuals and corporations in domestic and international aviation disasters connected to claims arising under the Warsaw Convention, Montreal Convention, Death on High Seas Act, and Federal Tort Claims Act.

  • Bankruptcy and Reorganization. Lead trial in 727 objection to discharge bankruptcy proceeding.  Consultant in federal bankruptcy actions involving cargo and Part 121 airline carriers.

  • Consumer Protection. Prosecuted and defended passengers and carriers in matters involving allegations of breach of contract, fraud, Air Carrier Access Act, Airline Deregulation Act, and violation of Florida's Deceptive and Unfair Trade Practices Act.

  • Labor and Airmen Enforcement Actions. Lead counsel for major aviation component manufacturer in defense of claims of sexual harassment, racial and gender discrimination, wrongful discharge, and occupational hazards.  Serve as AOPA counsel in airman enforcement and civil penalty / certificate actions.
